COMMUNITY BROADCASTERS ASSOCIATION REACTS TO WHITE SPACE RULING
Marietta, GA. (November 5, 2008) –The Community Broadcasters Association (CBA), the trade
association of the nation’s Class A and Low Power Television (LPTV) stations that represents the
interests of those stations in legislative, judicial, and regulatory matters, responds to the recent FCC
vote to allow unlicensed devices to use "White Spaces" in the TV band for wireless broadband.
The CBA’s VP of Technology, Greg Herman said, “The CBA is pleased that the FCC will initially approve devices that incorporate geo-location and a database to avoid interference to existing services. Our Industry’s hope is that the database will protect Class A and Low Power TV stations wherever they are actually viewed, in both analog and digital formats, and not based on only theoretical predicted service contours. We also trust that the FCC will subject any devices that rely on only spectrum-sensing to rigorous testing.”
In the most recent round of tests, these devices failed to detect viewable Class A and LPTV signals in one out of six observations. That obviously is not adequate. Improved performance is critical before these devices are brought to market.

The FCC announced today that on October 15, 2008, the Chairman will request a vote on a proposal that would allow Class A television stations to apply for full power television status and for low power broadcasters to have another opportunity to migrate to Class A status... and then to full power.
This regulation, if adopted, would be a tremendous opportunity for EVERYONE to upgrade its legal status to match the programming services you already offer to the Community. Among other things, an upgrade would provide your stations with the legal right to cable and satellite carriage that most do not have.
Any support that your Congressperson could give to the proposal, such as a letter to the FCC, would be most welcome. The key is to get the votes of the other Commissioners. Chairman Martin is already on board, but the other Commissioners have been reluctant to give him their support…..
Attached is the Press Release the CBA just sent. Also attached is a letter from CBA President Ron Bruno that went to each of the Commissioners last week, encouraging them to Vote YES to the Chairman’s proposal.

The Commission requests that communications providers expeditiously submit and update information through DIRS regarding, inter alia, the status of their communications equipment, restoration efforts, power ( i.e., whether they are using commercial power, generator or battery), and access to fuel, if they provide service to any areas listed below.

Below is the formal notice of the upcoming auction to choose among conflicting applications for companion digital channels.
The auction starts November 5!
To be eligible to bid, applicants must make the specified upfront payment to the FCC by wire transfer by October 10.
There will be a seminar and mock auction, so that applicants can learn about the bidding process and practice before the auction. All bidding will be by internet or telephone, none in person.
Applicants must not talk to one another at all about anything having to do with their application or the auction until the winning applicants have made their down payments safter the auction is concluded. Violation of this rule is cause for disqualification. Applicants should also make sure that their contact information on file with the FCC is up to date and that they have reported any changed circumstances that reduce their eligibility for the new entrant bidding credit. Contact information is important, because the FCC will send a bidding package to each applicant with a password needed to place bids.
If the underlying analog station has been sold since the companion channel application was filed, the companion channel application will be disqualified.
Applicants should watch for a public notice indicating which applications are qualified, which are dismissed as defective, and which will be dismissed if they are not amended to cure defects.

The CBA recently proposed to members of the Telecommunications
Subcommittee that qualifying LPTV and Class A stations should receive $150,000 each to assist them in making the digital transition.
All LPTV and Class A licensees who have responded have been in full support of this and the other proposals outlined in the letter below.
Please take the time to send this letter to your Congressional Representatives! Edit the information within the letter to make it personal about you, your station and your situation. Write one letter for EACH LPTV or Class A station you have. Then send it to your State and National Representatives.
To find your two Senators, go to www.senate.gov. To find your Congressperson, go to www.house.gov. These websites let you search for the names of Member of Congress from your state and district.
Once you’ve completed the letters, please forward signed copies to Mr. Broyles. If scanning, his e-mail is IBN@sbcglobal.net. The fax number is 281-774-9923. He will then organize and send the bound copies to CBA to be hand delivered to Chairman Markey, Chairman Dingell and Chairman Martin. The future of your stations is at risk. We must not fail!

All Class A television stations are required to have a copy of the FCC publication "The Public and Broadcasting" in their public inspection file. The FCC released a new version of this document today. Please alert all Class A stations that they must replace the version in their public file with the new version immediately.

When stations put their public files on the web, when and if the new web-posting FCC rules become effective, they may substitute a link to the document on the FCC's website for a paper document or electronic version in their own public file. Those rules are not yet effective, however; so station should print the new manual and keep the full document in their public file. The CBA hopes this information clarifies the rule making proceedings that will require all of our attention and comments to the FCC.

In its Supplemental Comments, DCS urges the Commission to take
action in accordance with a proposal advanced by the Community
Broadcasters Association ("CBA").[1] CBA proposes that the Commission
"actively support cable must-carry legislation for Class A stations."[2]
We agree that cable carriage of Class A television stations could
promote both programming diversity and localism, given that all such
stations are required to originate local content. We seek comment on
whether we have authority under the Act to adopt rules requiring such
carriage.

In the Matter of Broadcast Localism, MB Docket No. 04-233, FCC 07-218, released January 24, 2008:
141. As a final matter, we understand the concerns of commenters that
would like to upgrade LPTV stations to Class A status. We agree that
this action would provide investment protection for low power TV
stations looking to make investments in the DTV transition. Because the
Class A rules require such stations to provide locally produced
programming, increasing the number of Class A stations would ensure the
existence of continued community programming. We tentatively conclude
that we should allow additional qualified LPTV stations to be granted
Class A status. We seek comment on this tentative conclusion, as well
as on how to define eligibility and our statutory authority to take this
action.

Upgrading Class A to full power status. This is currently only an idea
from Chairman Martin. All four of the other Commissioners have
indicated a reluctance to support it, but they have not given their
reasons. It has never been put out for any formal comment and is not
embodied in any public written document.
